Up in Smoke: What the Legalization of Marijuana Means to the Connecticut HR Manager

In October, Massachusetts opened retail pot shops - two states not far from Hartford and Connecticut will likely be debating full legalization this year. For Connecticut employers, and particularly HR managers, changing laws and changing attitudes on marijuana will bring significant challenges.

In this discussion we’ll address the scope of the legalization matter; the impact that legalization will have on company policies and drug tests. We’ll look at what courts have said about employer drug testing in a legalized state, and what is likely in Connecticut. We’ll also take a look at the special problems of employees working in Drug Free Workplace Act companies, and safety-sensitive positions.

Key Learning Objectives of This Session:

·       Know the status of legalization in the US, New England, and specifically Connecticut;

·       Explain the state of both federal and Connecticut law;

·       Identify the issues facing the HR manager with medical marijuana and recreational marijuana;

·       Identify the actions HR should take in anticipation of problems arising in their organizations

Robert D. Noonan is an attorney and founder of Robert Noonan and Associates, a law firm that represents employers in federal and state courts and advises employers and several trade associations on employer-employee issues.  The firm’s clients are located in several states and the client’s foreign offices.

Prior to joining the firm, Bob served as Vice President and Counsel for the Connecticut Business and Industry Association.  He holds a juris doctor from the University of Connecticut School of Law as well as a master's degree in industrial relations, and a master's degree in sociology.

He is a recognized conference speaker, and has lectured both nationally and internationally on workplace issues.  Bob an adjunct faculty member at Central Connecticut State University and has taught in colleges throughout his career. He is admitted to practice before the Connecticut superior courts and the federal district courts.
